I am to invite kind attention to the references cited.

2) The Tamil Nadu State Election Commission has proposed to conduct elections to the local bodies to fill up the vacancies shortly. The rule 14 of the Tamil Nadu Panchayats (Elections) Rules, 1995 and rule 21 of the Tamil Nadu Urban Local Bodies Rules, 2023 envisage that electoral roll for local bodies shall be prepared before every ordinary or casual (Mid-term) election based on the current Assembly Electoral Rolls. 3) In the reference first cited, it has been stated that necessary amendments have been made in the Representation of People Act, 1950 the determining the eligibility of citizens for registration in electoral rolls with four qualifying dates i.e., 1st January, 1st April, 1st July and 1st October to the effect that the prospective electors who will become eligible for the enrolment in electoral roll with reference to 1st January, 1st April, 1st July and 1st October can submit their claims as directed by the Election Commission of India.

4) As per the provisions envisaged in the said Rules, the Tamil Nadu State Election Commission has to prepare the ward wise photo Electoral Rolls for Local Bodies based on the current Electoral Rolls of Assembly constituencies published by the Election Commission of India on 27.03.2024 (i.e) last date of making nomination of Lok Sabha Elections, 2024 and subsequent updation prepared if any as stated in para 3 above, if any.

5) I am to request that necessary instructions to all the District election officers/District Collectors may be issued to provide the hard copies of Assembly Electoral Rolls which were already published on 27.03.2024. The hard copies of Assembly Electoral Rolls for the period from 28.03.2024 and the continuous latest updation may also be provided to the Electoral Registration Officers of the local bodies concerned. Further, the soft copies (Database) of the aforesaid Electoral roll may also be provided to the Tamil Nadu State Election Commission to fulfill the statutory obligation of preparation of Electoral rolls of local bodies.

6) Necessary Undertaking to this effect on the following lines furnished herewith by the Tamil Nadu State Election Commission for sharing the database of current Assembly Electoral Rolls for the online preparation of Photo Electoral Roll of Local Bodies. i) In case of any dispute between the printed and soft copies, the printed copy of electoral roll would be deemed to be the authentic copy by the State Election Commission.

ii) The data base / pdf would be used only for the purpose for which it is being given.

iii) The State Election. Commission would take all precautions and field verifications for the preparation of its own data base and the Election Commission of India would not to be committed to have any responsibility as to the veracity and authenticity of such data base prepared by State Election Commission notwithstanding the fact that State Election Commission had used the database provided by Election Commission of India.

iv) State Election Commission shall ensure that the database / pdf of the Election Commission of India is not passed on to any other agency / organization. Full security of the database / pdf shall be ensured and the safe I koop and-benafide use of the database shall be the responsibility of the State Election Commission.

v) In no case, the State Election Commission shall share the soft copy of images with anyone including political parties or candidates. 7) I am, therefore to request that the latest copies/database as requested in para 5-above may be provided to the concerned. Further, I am to request that necessary instructions may be given to the District Election Officers/District Collectors to provide the hard copies of Assembly Electoral Rolls up to the last date of filing nominations before the concerned Electoral Registration Officers of the concerned Local bodies as per the schedule of programme of Elections to be announced by the Tamil Nadu State Election Commission. The Communication regarding schedule of election will be sent by the Tamil Nadu State Election Commission at an appropriate time.
