RTE 2009 சட்டத்திற்கு முன்பு பணி நியமனம் பெற்ற ஆசிரியர்களுக்கு ஆசிரியர் தகுதித்தேர்வில் விலக்கு பெற NCTE CHAIR MAN DR பங்கஜ் அரோரா மற்றும் அலுவலர்களுடன் ABRSM நிர்வாகிகளுடன் தேசிய ஆசிரியர் சங்கம் தமிழ்நாடு பொதுச் செயலாளர் கந்தசாமி சந்திப்பு!!!

இன்று (7-11-25)புதுடெல்லி NCTE தலைமை அலுவலகத்தில் அதன் தலைவர் DR பங்கஜ் அரோரா, உறுப்பினர் செயலர் செல்வி அபிலாஷா ஜா மிஸ்ரா , மற்றும் அனைத்து செயலாளர்கள் அடங்கிய குழுவுடன் அகில பாரத தேசிய கல்விக் கூட்டமைப்பு (ABRSM) அமைப்புச்செயலாளர் திரு மகேந்திர கபூர், பொதுச் செயலாளர் திருமதி கீதா பட், தேசிய ஆசிரியர் சங்கம் தமிழ்நாடு பொதுச் செயலாளர் திரு கந்தசாமி உள்ளிட்ட குழுவினர் சந்தித்து TET தகுதித்தேர்வில் இருந்து அந்தந்த மாநிலங்களில் RTE ACT அமலுக்கு வந்த நாளுக்கு முன்பு நியமனம் பெற்ற 1-8 வகுப்பு போதிக்கும் ஆசிரியர்களுக்கு விலக்கு அளிக்க செய்ய வேண்டிய நடவடிக்கைகள் குறித்து கருத்து பரிமாற்றம் செய்யப்பட்டது.

1)ஆசிரியர் தகுதித்தேர்வை முன் தேதியிட்டு நடைமுறைப்படுத்தக்கூடாது.

2) இவ்வாறு நடைமுறைப்படுத்துவது அரசியலமைப்பு சட்டத்திற்கும் அடிப்படை உரிமைகளையும் மீறும் செயலாகும்.

3) 23-8-2010 நாளிட்ட NCTE notification இல் குறிப்பிட்டவாறு அதற்கு முன் நியமனம் பெற்ற மற்றும் நியமன நடவடிக்கைகள் துவங்கப்பட்ட அனைவரின் பணிப்பாதுகாப்பு,பதவி உயர்வு உறுதி செய்யப்பட வேண்டும். 4) அரசு உதவி பெறும் பள்ளிகளில் பணிநியமனம் பெற்றவர்களைப்பொறுத்த வரை அந்தந்த மாநில அரசுகள் செயல்முறைகள் வெளியிட்ட நாளுக்கு முன்பு வரை நியமனம் பெற்றவர்களுக்கு தகுதித்தேர்வில் இருந்து விலக்கு அளிக்க வேண்டும்.

5) இந்நிகழ்வில் NCTE மறு சீராய்வு மனு தாக்கல் செய்யும் வழிவகைகளை ஆராய வேண்டும்.

6) மத்திய அரசுக்கு உரிய சட்ட திருத்தம் செய்யும் வகையில் NCTE கருத்துருக்களை அனுப்ப வேண்டும்.

7) புதிதாக நடத்தப்படும் தகுதித்தேர்வுகளில் அந்தந்த பாடங்களிலும் கல்வி உளவியலிலும் மட்டுமே பாடத்திட்டம் இருக்க வேண்டும் போன்றவை வலியுறுத்தப்பட்டது. கருத்துகளுக்கு பதிலளித்த NCTE CHAIRMAN இது குறித்து மத்திய கல்வி அமைச்சருடன் விரைவில் ஆலோசனை செய்ய உள்ளதாகவும் , ஏற்கனவே ABRSM மூலம் மாண்புமிகு பாரதப் பிரதமருக்கு அனுப்பப்பட்ட கடிதம் குறித்து வரும் நவம்பர் 18 இல் விவாதிக்க அழைத்துள்ளதாகவும், NCTE ஆசிரியர் நலனுக்கு ஆதரவான நிலையை உறுதி செய்வதாகவும் தெரிவித்தார் நமது கோரிக்கைகளை உரிய சட்ட வல்லுனர்களுடன் கலந்து பேசி தெரிவிப்பதாகவும் கூறினார். 90 நிமிடங்களுக்கு மேல் நடந்த கருத்து பரிமாற்றத்தில் அகில இந்திய பள்ளிக்கல்வி பிரிவின் செயலாளர் திரு மோகன் புரோகித், தேசிய செயலாளர் திரு பவன் மிஸ்ரா, தெலுங்கானா மாநில TPUS மாநிலத்தலைவர் திரு ஹனுமந்தராவ் ஆகியோர் கலந்து கொண்டனர்.

Sub: Appeal for intervention regarding Supreme Court verdict on 01.09.2025 on Teacher Eligibility Test (TET)-NCTE Notification on 23.08.2010 with effect from the issue of the notification-Exempt from TET who were appointed prior to the above notification for continuing in Service as well as Promotion.

Respected Sir, Akhil Bhartiya Rashtriya Shaikshik Mahasangh (ABRSM) is a teacher's organization which has its branches in 29 states and union territories with more than 13.5 lakh members from primary school teachers to higher education. On behalf of the teaching community across the country, ABRSM humbly submits seeking your kind intervention regarding the recent judgement of the Honourable Supreme Court of India in Civil Appeal No. 1385/2025, Dt. 01.09.2025. The judgement makes TET mandatory to all in-service teachers irrespective of their date of appointment, creating a situation that threatens the livelihood and service security of nearly 20 lakh teachers across the country.

As per the NCTE Notification dated 23.08.2010, it clearly mentioned that the minimum qualifications to be eligible for appointment as a teacher in Class I to VIII in a school in clause (n) of Section 2 of the Right of Children to Free and Compulsory Education Act (RTE), 2009 with effect from the date of abovementioned notification.

Our humble request:

1. Ensure that the verdict is applied prospectively and not retrospectively. Different states passed RTE act in their state assemblies in different years. The cutoff date for mandatory passing TET must be fixed accordingly as per the state gazette/nodal agency notification in the states.

2 Protect the service seniority and dignity of experienced teachers appointed under the valid academic and professional qualifications. 3. Initiate necessary legal measures to safeguard lakhs of teachers from terminations and promotions.

ABRSM firmly believes in maintaining the quality and standards in education, but it is equally essential to uphold the rights and dignity of teachers who have devoted their lives to this noble profession.
