கல்வி நிறுவனங்களில் நடைபெறும் நிகழ்ச்சிகளுக்கு 10 சதவீதம் கேளிக்கை வரி விதிப்பு

கடந்த டிசம்பர் நடைபெற்ற சட்டப்பேரவை கூட்டத் தொடரில் இந்த மசோதா நிறைவேற்றப்பட்டது. The following Act of the Tamil Nadu Legislative Assembly received the assent of the Governor on the 17th April 2025 and is hereby published for general information:- ACT No.24 OF 2025.

An Act further to Amend the Tamil Nadu Local Authorities Entertainments Tax Act, 2017.

BE it enacted by the Legislative Assembly of the State of Tamil Nadu in the Seventy-fifth Year of the Republic of India as follows:-

Short title and commencement

1. (1) This Act may be called the Tamil Nadu Local Authorities Entertainments Tax (Amendment) Act, 2024.

Amendment of section 2.

(2) It shall come into force at once.

2. In section 2 of the Tamil Nadu Local Authorities Entertainments Tax Act, 2017 (hereinafter referred to as the principal Act),-

Tamil Nadu Act 20 of 2017.

(a) in clause (8), after the expression "payment for admission", the following expression shall be inserted, namely:-

"or concert, drama, show or any other event conducted in the premises of any institution or in any other place for which persons are required to make payment for admission by way of ticket or contribution or subscription or any other charges collected in any manner whatsoever":

(b) for clause (10), the following clause shall be substituted, namely:-

"(10) "institution" includes any educational institution or company, society, club or any other association of persons by whatever name called;";

(c) for clause (11), the following clause shall be substituted, namely:-

"(11) "local authority" means a municipal corporation or a municipal council or a town panchayat constituted or deemed to have been constituted under the Tamil Nadu Urban Local Bodies Act, 1998 (Tamil Nadu Act 9 of 1999) or a village panchayat constituted under the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994), in whose jurisdiction the entertainment is provided;";

(d) in clause (16), after the expression "any person or body of persons conducting other tournaments", the expression "or any person or body of persons conducting any concert, drama, show or any other event", shall be inserted.

கல்வி நிறுவனம், குழுமங்களில் நடைபெறும் கலை நிகழ்ச்சிகளுக்கு, உள்ளாட்சி அமைப்புகள் 10 சதவீதம் கேளிக்கை வரி விதிக்கும் சட்ட மசோதாவுக்கு ஆளுநர் ஆர்.என்.ரவி ஒப்புதல் அளித்துள்ளார்.

தமிழ்நாடு உள்ளாட்சி அமைப்புகள் கேளிக்கை வரிச் சட்டத்தில் குறிப்பிடப்பட்டுள்ள கேளிக்கைகள் மற்றும் பொழுதுபோக்குகள் மீது வரி விதிக்கவும், வசூலிக்கவும் உள்ளாட்சி அமைப்புகளுக்கு அதிகாரம் வழங்கப்பட்டுள்ளது. ஆனால் கல்வி நிறுவனம் உள்ளிட்ட எந்தவொரு நிறுவனத்தால் அனுமதி கட்டணம் வசூலித்து நடத்தப்படும் இசை நிகழ்ச்சி, நாடகம், காட்சி அல்லது பிற நிகழ்ச்சிகள் எதற்கும் கேளிக்கை வரி விதிக்கவும், வசூலிக்கவும் உள்ளாட்சி அமைப்புகளுக்கு அதிகாரம் அளிக்க சட்டங்கள் எதுவும் இல்லாமல் இருந்தது. இந்நிலையில், அதுபோன்ற நிகழ்ச்சிகளுக்கான அனுமதிக் கட்டணத்தின் மீது 10 சதவீதம் கேளிக்கைகள் வரி விதிக்கவும், வசூலிக்கவும் உள்ளாட்சி அமைப்புகளுக்கு வழிவகை செய்ய அரசு முடிவெடுத்திருந்தது. அதனைத் தொடர்ந்து, தமிழக சட்டப்பேரவையில், நகராட்சி நிர்வாகத் துறை அமைச்சர் கே.என்.நேரு, தமிழ்நாடு உள்ளாட்சி அமைப்புகள் கேளிக்கை வரிச்சட்டத்தை திருத்தம் செய்வதற்கான மசோதாவை கடந்த டிசம்பர் மாதம் தாக்கல் செய்திருந்தார். இச்சட்டம் டிசம்பர் மாதமே நிறைவேற்றப்பட்டு, ஆளுநர் ஆர்.என்.ரவியின் ஒப்புதலுக்காக அனுப்பி வைக்கப்பட்டது.

இந்த மசோதாவின்படி, தமிழ்நாடு உள்ளாட்சி அமைப்புகளின் கேளிக்கை வரிச்சட்டத்தில் திருத்தம் செய்து, புதிய பிரிவு சேர்க்கப்பட்டுள்ளது. அதனடிப்படையில் கல்வி நிறுவனம், சங்கம், குழுமம், யாருடைய பெயரிலாவது அமைக்கப்பட்டுள்ள கழகம் போன்ற நிறுவனங்களின் வளாகங்கள் மற்றும் நுழைவுச்சீட்டு அல்லது பங்களிப்பு அல்லது சந்தா போன்ற கட்டணங்கள் செலுத்த வேண்டிய இடங்கள் ஆகியவற்றில் நடத்தப்படும் இசை நிகழ்ச்சி, நாடகம், காட்சி அல்லது பிற நிகழ்ச்சியின் அனுமதிக் கட்டணத்தில் மாநகராட்சி உள்ளிட்ட உள்ளாட்சி அமைப்புகள் 10 சதவீதம் கேளிக்கை வரி வசூலிக்கும் வகையில் சட்டத் திருத்தம் செய்யப்பட்டுள்ளது. இதற்கு ஆளுநர் ஒப்புதல் அளித்த நிலையில், இச்சட்டத் திருத்தம் அரசிதழில் வெளியிடப்பட்டுள்ளது.
